Tichawnda Chamuka and Hope Farm Residents Association v Mamina Hope Resources (Pvt) Ltd and Ministry of Lands, Agriculture, Fisheries, Water, and Rural Development

The applicants sought an urgent provisional interdict to prevent the 1st respondent from carrying out development on Hope Farm. The 1st respondent is the registered owner of the farm by virtue of Title Deed No. 122/2001. The applicants based their claim on an offer letter dated 30 August 2023 purporting to resettle them on the land. The 1st respondent brought machinery to the property on 13 March 2026 and commenced development. The applicants had been evicted in 2019 and returned without a court order. In November 2025, the applicants were issued with a notice of eviction. On 8 August 2018, the government issued the 1st respondent with a Subdivision Permit to subdivide the land. The High Court had previously ruled on four occasions (2004, 2013, 2018, and 2025) in favor of the 1st respondent and declared the gazetting/acquisition of Hope Farm a nullity.

The binding legal principles established are: (1) A title deed is the definitive proof of legal land ownership in Zimbabwe (described as "the fingerprint or DNA of legal land ownership"); (2) For valid resettlement, land must first be properly acquired by government and the acquisition must be gazetted; the validity of any offer letter or permit is necessarily premised on the validity of the land acquisition; (3) Where courts have declared a land acquisition/gazetting to be a nullity, any offer letters or permits based on that acquisition are also nullities by extension; (4) What is legal (i.e., development authorized by a valid subdivision permit) cannot be interdicted; (5) There must be finality to litigation, and repeated court pronouncements on the same dispute must be respected regardless of who the particular litigants are.

The court made non-binding observations on the general rule regarding provisional interdicts, noting that "the general approach is that the provisional order should be worded differently from the final order" to prevent applicants from obtaining final relief before the return day, thereby rendering confirmation proceedings superfluous. However, the court observed that "the general rule, however, is not cast in stone" and that "there are exceptions to the general rule, depending on the circumstances of the particular case." The court also made an observation about the applicants' approach, noting they "have put the condition precedent to the granting of a final order out of their hands, and that is awkward" because they had not applied for a court order to authorize developments, but found this "not to be fatal in the totality of the circumstances of this dispute."

This case reinforces several important principles in Zimbabwean property and land reform law: (1) the primacy of registered title deeds as proof of legal ownership; (2) the requirement that land acquisition for resettlement must be properly gazetted, and that offer letters based on nullified acquisitions are themselves invalid; (3) the principle that lawful activity authorized by valid permits cannot be interdicted; (4) the doctrine of res judicata and the need for finality in litigation where courts have repeatedly pronounced on the same dispute; and (5) the importance of compliance with proper land reform procedures. The case demonstrates judicial consistency in upholding property rights where land acquisition processes have been found to be invalid.
