The State v Juliet Philip

The accused, a 23-year-old woman, was the stepmother of a 6-year-old boy named Simon Gwana. On an unknown date in November 2016 at Chakari, she left her 2-year-old baby in the care of the complainant. Upon her return, she discovered that the 2-year-old baby had suffered burns while playing with the complainant. In anger, the accused forcibly took hold of the complainant's right hand and burned two of his fingers on a hot fireplace, intending to cause him harm as punishment. The accused was a married mother with one child, a subsistence farmer with negligible means (possessing only $2 and two chickens), and was a first offender who pleaded guilty.

1. The conviction of the accused is confirmed. 2. The sentence imposed by the magistrate (18 months imprisonment with 6 months suspended for 5 years) is set aside and substituted with 6 months imprisonment of which 4 months imprisonment is suspended for 5 years on condition that the accused does not within that period commit any offence in which assault is an element and for which upon conviction she is sentenced to imprisonment without the option of a fine. 3. As the accused had been in custody since 20 April 2017, she was entitled to immediate release and a warrant for her liberation was to be issued immediately.

The binding legal principles established are: (1) Imprisonment should be imposed as a last resort only after all other competent alternative forms of punishment have been considered and adequately discounted with reasons given. (2) Where an offence attracts a sentence other than imprisonment as a competent sentence, the sentencing court must go into detail to justify why the more rigorous punishment of imprisonment is considered most appropriate. (3) A sentencing court commits a misdirection when it dismisses a statutorily competent alternative sentence (such as a fine) without adequate justification and factual basis. (4) When presiding over cases involving unrepresented accused persons, magistrates must take an active role in soliciting facts necessary to properly and objectively assess sentence without being emotive or acting with caprice. (5) A review court may interfere with a sentence where the trial court misdirected itself or where the sentence is so severe as to induce shock and does not accord with real and substantial justice. (6) Each case must be determined on its own peculiar facts, and there is no room for a tariff approach to sentencing where courts are required to exercise discretion.

The court made several non-binding observations: (1) The court noted that s 89(3)(d) of the Criminal Law Codification & Reform Act requires consideration of whether assault was committed with intent to inflict serious bodily harm, and observed that the accused appeared to intend only to punish the complainant by subjecting him to similar injury suffered by the baby, rather than to inflict serious bodily harm. (2) The court acknowledged the general policy of courts to spare first offenders from effective custodial sentences, while noting this is not a rule of law. (3) The court referenced and distinguished S v Sibanda 2015 (1) ZLR 681 (H), finding it instructive but distinguishable on facts (more severe injuries, treatment required, accused lied to clinic staff showing lack of remorse). (4) The court emphasized its role and duty as upper guardian of minor children under s 81(3) of the Constitution to jealously protect children's interests. (5) The court noted the relevance of ss 53 and 81 of the Constitution regarding prohibition of torture/cruel treatment and children's entitlement to parental care, which the accused violated.
