Thabani Mpofu and Others v The State

The applicants were four individuals employed in the Prime Minister's office and Attorney General's office in Zimbabwe. The first applicant, Thabani Mpofu (Principal Director in the Prime Minister's office), faced two separate sets of charges: (1) jointly with the other three applicants - contravening the Official Secrets Act, Criminal Law (Codification and Reform) Act relating to unlawful communication of official information and possession of articles for criminal use; and (2) separately, two counts under the Firearms Act involving failure to renew his firearm licence and to secure the firearm. The second, third and fourth applicants (Felix Matsinde, Warship Dumba, and Methuli Tshuma) were also employed in the Prime Minister's office or Attorney General's office. All four applicants were denied bail by the Magistrates Court and appealed to the High Court.

When determining bail applications, judicial officers are duty bound to: (1) provide cogent, well-reasoned bases for their decisions backed by proper findings of fact; (2) meticulously observe judicial safeguards and guidelines established by superior courts, particularly the principles in S v Hussey 1991 (2) ZLR 187 (SC) and S v Maharaj 1976 (3) SA 205; (3) bear in mind that detention pending trial is administrative rather than penal detention and the presumption of innocence operates in favour of the accused at every stage before conviction; (4) apply reasoning that is logical and consistent with common sense and reality. Failure to adhere to these requirements constitutes a material misdirection that entitles an appellate court to consider the matter afresh on the merits.

The Court made observations about Zimbabwe's borders being porous but noted the police force has a proven track record of tracking and apprehending fugitives from justice, as demonstrated in the 'legendary cases of Masendeke and Chidumo'. The Court also observed that the State has total control over the issuance of firearm licences and could easily deny an applicant a licence or the court could bar acquisition of a firearm licence for a specified period, rendering concerns about repeat firearms offences manageable through less restrictive means than detention. The Court noted that well-known public figures with fixed abode and firm roots in the country have 'nowhere to hide' save to skip borders, making absconding less likely.

It emphasizes that the presumption of innocence operates at the bail stage and that detention pending trial is administrative rather than penal in nature.
