Penxa v Central Karoo District and Others

The applicant (Penxa), along with the fifth respondent (Links) and the fourth respondent (Nkungwana), applied for the position of Municipal Manager for the Central Karoo District Municipality. All three candidates underwent a municipal leadership competency assessment conducted by the South Africa Local Government Association in partnership with Encapsulate Consulting. The applicant achieved an overall achievement level of 'competent' in all eight competency proficiency areas assessed. Both Links and Nkungwana achieved 'competent' in only four areas and 'basic' in the other four, resulting in an overall achievement level of 'basic'. Despite this, the Municipality appointed Nkungwana as Municipal Manager in January 2024. The applicant challenged this appointment, arguing that Nkungwana did not meet the prescribed competency requirements under the applicable legislation. During proceedings, concerns were raised about irregularities in the recruitment process, including observations by a trade union observer that Nkungwana appeared to have prior knowledge of interview questions, and the emergence of documents suggesting interference by senior municipal officials.

The application was heard as a matter of urgency and non-compliance with time limits, forms and procedures was condoned. The decision of the Central Karoo District Municipality Council to appoint Nkungwana as Municipal Manager on 10 January 2024 was reviewed and set aside for contravention of section 54A(2) and (3)(a) of the Local Government: Municipal Systems Act read with the Regulations. The selection process and decision to appoint a Municipal Manager was remitted back to the Central Karoo District Municipality Council. The first, second, third and fourth respondents were ordered to pay costs jointly and severally.

For appointment as a Municipal Manager under section 54A of the Local Government: Municipal Systems Act read with the Regulations on Appointment and Conditions of Employment of Senior Managers, a candidate must achieve at least a 'competent' achievement level in the competency assessment framework set out in Annexure A. An achievement level of 'basic' is insufficient for appointment as a senior manager, as section 6.1 of Annexure A explicitly deems individuals within the basic range unsuitable for the role. The only exception is where the Municipality is unable to attract suitable candidates and applies to the Minister for a waiver under section 54A(11). The appointment of a person who does not have the prescribed competencies is null and void under section 54A(3)(a).

The court observed that a Municipal Manager who cannot stand their ground in the highly charged terrain where public interest, political and ideological as well as Constitutional Democratic State Administration contest for hegemony would simply be a disaster. The court also noted that Nkungwana ran the risk of being a useful tool for politicians, which would result in the Municipality having no State Administration, with the Mayor making administrative decisions on behalf of the State. The court further commented that it would be odd for Council to appoint a manager under section 56 to supervise and develop the Municipal Manager, when such manager is accountable to the Municipal Manager, as a mentor cannot be required to justify their actions to a mentee.

This case provides authoritative interpretation of the competency requirements for appointment of Municipal Managers under the Local Government: Municipal Systems Act and the 2014 Regulations. It clarifies that achieving a 'basic' competency level is legally insufficient for appointment as a Municipal Manager, and that the 'competent' level is the minimum threshold.
