Mehluli Dube and Lovemore Ndlovu v The State

The two appellants were charged with robbery in the Regional Court. The complainant, Martin Richards, was confronted by two or three intruders in the passage of his house at approximately 07:15 hours in the morning (daylight). The assailants fought with him, demanded his car keys, tied his hands and legs, and stuffed material in his mouth. One of the assailants (the shorter one) approached him with a knife and demanded money. They pushed him off the bed and later removed the material from his mouth to get information on how to start the car. Various items were stolen including a motor vehicle, microwave, DVD, and laptop. The complainant identified both appellants as his assailants. Accused one sold a microwave and DVD to a witness named Sidingulwazi Ncube. Accused one led police to recover some stolen property including a laptop and DVD, and both accused led police to a cave where part of the property was recovered. Both appellants pleaded not guilty but were convicted and each sentenced to 15 years imprisonment, with 3 years suspended for 5 years on conditions.

The binding legal principles established are: (1) Identification evidence by a victim who had ample opportunity to observe perpetrators during good visibility conditions and through extended interaction is reliable and admissible; (2) Identification evidence can be properly corroborated by evidence of possession of stolen property, disposal of such property, and false explanations about the source of the property; (3) Hearsay evidence and statements by accused persons to police must not be admitted unless proper procedures are followed, including warnings and cautions, and the court must satisfy itself that statements were made freely and voluntarily; (4) A conviction based on sufficient admissible evidence will not be overturned merely because inadmissible hearsay evidence was also led, provided the inadmissible evidence did not form the basis of the conviction; (5) An identification parade is not mandatory where there is strong identification evidence based on direct observation under favorable conditions.

The court made important obiter observations expressing serious concern about the widespread disregard of hearsay rules by magistrates and prosecutors. CHEDA AJ stated: "It is a cause for concern that the magistrate and the prosecutor ignored completely the well established rules concerning hearsay evidence." The court went on to provide detailed guidance on when hearsay evidence may be admissible, noting exceptions where the accused was present and heard what was said but failed to respond, or where a witness confirms what another witness stated in the presence of the accused. The court emphasized that "Such hearsay evidence is in breach of the general rules of procedure and should never be allowed as it will lead to a mistrial. Such evidence has the potential to seriously prejudice the accused person." These observations serve as a stern reminder to lower courts and prosecutors about the fundamental importance of evidence rules in ensuring fair trials, even though in this particular case the irregularities did not affect the outcome.
