Meepo Ya Sechaba v Kotze, Jan Louis Koen and Others

Meepo Ya Sechaba (the applicant) was granted a prospecting right to prospect for diamonds on the Remainder of Farm Lanyon Vale no. 376 in the district of Hay, issued by the Regional Manager on 1 July 2005 in terms of the Mineral and Petroleum Resources Development Act 28 of 2002 (MPRDA). From July 2005 onward, Meepo approached Kotze (the first respondent and land owner) for access to the farm to exercise its prospecting rights. Kotze refused access, contending that Meepo's prospecting right was void ab initio. Meepo then applied for declaratory relief entitling it to immediate access and to commence prospecting activities. Kotze and Bathopele Mining Investments (the second respondent) counter-applied to review and set aside Meepo's prospecting right. The respondents had previously applied for a prospecting permit under the Minerals Act 50 of 1991 in July 2001, which application had not been finalized before the MPRDA came into force on 1 May 2004. Two prospecting rights were issued to Meepo: the first on 24 March 2005 (unregistered) and the second on 1 July 2005 (registered on 18 July 2005), which purported to replace the first.

The main application was dismissed. The counter-application succeeded. The Second Prospecting Right dated 1 July 2005 was declared null and void. The third and fourth respondents (Regional Manager and Minister) were directed to process the respondents' 2001 application for a prospecting permit as a pending application under the MPRDA. Costs: Meepo to pay the first and second respondents' costs in the main application. Meepo and the third and fourth respondents to pay the first and second respondents' costs in the counter-application jointly and severally. All respondents to pay Meepo's wasted costs from the 28 March 2007 postponement jointly and severally.

The binding legal principles established are: (1) Section 5(4)(c) of the MPRDA requires a holder of a prospecting right to notify and consult with the land owner after the prospecting right has been granted and before commencing prospecting activities on the land. This consultation is distinct from the pre-grant consultation required by section 16(4)(b). (2) A prospecting right is granted when the authorized official and the applicant execute a notarial deed setting out the determined terms and conditions of the right, not when internal departmental approval is given. (3) A Regional Manager has no original or delegated power to grant a prospecting right unless validly delegated by the Minister. A power of attorney purporting to authorize a Regional Manager to sign a prospecting right on behalf of the Minister or DDG, where further delegation has been expressly prohibited, is invalid and any prospecting right granted pursuant thereto is ultra vires and void. (4) Where a prospecting right purports to replace an earlier prospecting right but materially differs from it (including in period of validity and area description), it constitutes a new grant requiring proper authorization, not merely a correction of clerical errors. (5) Applications for prospecting permits lodged under the Minerals Act 50 of 1991 that had not been finalized (refused or granted) before the commencement of the MPRDA on 1 May 2004 are "pending applications" under Item 3 of Schedule II of the MPRDA and must be processed in accordance with the MPRDA in preference to new applications lodged after commencement.

The court made several non-binding observations: (1) The provisions of the MPRDA should be interpreted with due regard to constitutional values and in a manner that achieves a rational balance between the rights of holders of prospecting rights and the property rights of land owners (both protected in the Bill of Rights). (2) Sections providing for consultation between applicants/holders and land owners should be construed widely given their importance in protecting land owner rights. (3) The legal nature of a prospecting right is essentially contractual, whereby the Minister consensually grants a limited real right subject to terms and conditions. (4) It is arguable (though not finally decided) that section 96 of the MPRDA regulates "the whole subject" of access to courts for review of administrative decisions under the Act and may exclude the application of section 7(2)(c) of PAJA (exemption from exhausting internal remedies). (5) Even where statutory formalities are peremptory, not every deviation is fatal - the question is whether the object of the statutory provision has been achieved. (6) Civil courts exist to do justice, not to provide a forum for technical points that prevent adjudication on real issues. (7) The consultation process envisaged in section 5(4)(c) is the primary means afforded to land owners to protect their rights and "soften the blow" of the exercise of prospecting rights on their property.

This case is significant in South African mining law because: (1) It clarifies that section 5(4)(c) of the MPRDA requires post-grant consultation between a holder of a prospecting right and the land owner before prospecting activities can commence, in addition to the pre-grant consultation required under section 16(4)(b). This interpretation gives effect to the constitutional property rights of land owners. (2) It establishes that a prospecting right is granted when the notarial deed is executed and the terms and conditions are determined and communicated to the applicant, not merely when departmental approval is given. (3) It reinforces that officials must act within their delegated authority when granting prospecting rights, and that ultra vires acts by officials will result in the invalidity of prospecting rights. (4) It confirms that applications lodged under the old Minerals Act that were still pending when the MPRDA came into force must be treated as pending applications under Schedule II and processed in preference to new applications under the MPRDA. (5) It demonstrates the court's willingness to adopt a substantive rather than purely technical approach to procedural requirements such as exhaustion of internal remedies where the interests of justice so require.
