Kenneth Mupamba and Simbarashe Tinoza v The State

The applicants were jointly charged with and convicted of assault after a contested trial. Both were sentenced to 14 months imprisonment of which 6 months were suspended on the usual conditions of good behaviour. They noted their appeal against both conviction and sentence and applied for bail pending appeal, which was dismissed by the magistrate's court. They then appealed to the High Court against the refusal of bail. The State did not oppose bail for Simbarashe Tinoza but opposed it for Kenneth Mupamba. The evidence showed that Tinoza was arrested because he owned a motor vehicle similar to one used by the perpetrators (registration ACF 1838 versus ACF 1835 used in the assault), but he was not positively identified by witnesses except the complainant. Kenneth Mupamba, however, was present at the scene, appeared drunk, and participated in the assault according to multiple witnesses including defence witnesses. The assault was perpetrated by a group against the complainant, endangering passengers in the complainant's vehicle.

The court also observed that it was "putting it too highly" to say bail should only be granted where there is reasonable prospect of appeal succeeding, citing S v Williams. The court commented that the assault in this case was "needless" and endangered the lives of passengers, and that the magistrate's court properly discounted community service as a sentencing option given the nature of the assault.
