Mr Ernest Theron was employed as the Chief Executive Officer of the Western Cape Provincial Development Council on a fixed-term contract running from 1 July 2009 to 30 June 2012. The contract provided for automatic termination on the end date but also allowed either party to terminate the contract on one month’s written notice. In December 2011, the Council was disestablished following the repeal of its establishing statute. Its assets and liabilities were transferred to the Department of the Premier. Theron’s employment ended upon disestablishment. He was paid outstanding benefits, including a bonus, leave pay, severance pay, and one month’s notice salary. Theron claimed further damages equal to the salary he would have earned until 30 June 2012, arguing that the termination was premature and unlawful.
