Le Roux and Others v Dey

Three schoolboys created and distributed a digitally manipulated image depicting two naked men in a sexually suggestive pose, with the faces of their school principal and deputy principal, Dr Louis Dey, superimposed and the school crest covering the genital area. The image was circulated via cellphone and displayed briefly on a school noticeboard. Dr Dey sued the learners for defamation and impairment of dignity. The High Court and Supreme Court of Appeal held the image defamatory and awarded R45 000 damages. The learners applied to the Constitutional Court, relying on constitutional rights including freedom of expression and children’s rights.

Appeal upheld in part. The orders of the High Court and Supreme Court of Appeal were set aside and replaced with an order directing the applicants to pay Dr Dey R25 000 in damages, tender an unconditional apology, and pay High Court costs. No costs were awarded in the Supreme Court of Appeal or Constitutional Court.
