Mr Tate Matthew Sibanyoni and his family had lived since 2011 on the farm Vaalbank in Mpumalanga, land owned by the estate of the late Mr MJC van der Merwe. They erected a permanent dwelling and were common cause occupiers as defined in the Extension of Security of Tenure Act 62 of 1997 (ESTA). A dispute arose when Mr Sibanyoni sought to install and connect electricity to his dwelling. He alleged that consent had been granted by Vincent, the person in charge of the farm at the time, and that a consent form was signed. Ms Maria Johanna Kruger, the appellant and person in charge of the land, denied that consent was given and prevented Eskom from delivering electricity poles, contending that landowner consent was required and that electricity installation could expose her to liabilities. The Land Claims Court ordered Ms Kruger to consent to the installation and interdicted her from preventing it. She appealed to the Supreme Court of Appeal.
