Upenyu Mashangwa v Blessing Mashangwa

The applicant and respondent are husband and wife sharing a matrimonial home at No. 655, Brooke Drive, Borrowdale Brooke, Harare, while undergoing divorce proceedings (Case No. HC 2252/19 initiated in 2019). The applicant alleged that the respondent partitioned the matrimonial house to restrict his access to key facilities such as the kitchen, dining room and lounges, and constructed a durawall on the property around 11 February 2022 without his consent. He claimed she intended to lease the property to a third party, thereby alienating him from the property. The applicant sought a spoliation order (mandament van spolie) to restore unrestricted, peaceful and undisturbed possession. The respondent denied partitioning the house and stated the wall was constructed on a small section of the yard for fundraising functions for the children's upkeep. Crucially, the applicant was on bail for domestic violence charges with bail conditions prohibiting him from staying at the matrimonial home. He appeared on initial remand on 11 January 2022 with the next remand date being 28 February 2022.

For a spoliation order to be granted, an applicant must prove actual possession (comprising both physical control/detentio and the requisite mental state) at the time of the alleged spoliation, not merely a right to possession. Where an extant court order prevents an applicant from occupying property, the applicant cannot establish the peaceful and undisturbed possession required for spoliation relief. The existence of such a court order defeats the fundamental requirement of possession, regardless of the applicant's views on the merits or lawfulness of that order (which must be challenged through appropriate procedures). An intended or anticipated action (such as a proposed lease agreement) that has not materialized cannot constitute spoliation as it has not yet resulted in dispossession.

The court observed that the relationship between the parties was strained, with ongoing divorce proceedings and allegations of infidelity, embezzlement and physical violence, but noted these issues were not before the court and would likely be ventilated in the pending divorce or criminal proceedings. The court cautioned against being drawn into aspects of marital disputes that fall outside the scope of spoliation proceedings. The court noted that issues of alleged illegal subdivision of property are matters for the relevant municipal authority and may require evidence beyond the scope of spoliation proceedings. The court suggested that if the applicant wished to prevent the conclusion of a lease agreement, appropriate legal remedies could be sought, but this was not a matter for spoliation relief. The court also commented that resolution of the marital dispute would inevitably involve determination of the parties' respective rights in the matrimonial property, and it was up to the parties to expedite those proceedings.

This case clarifies the distinction between the right to possession (ius possidendi) and actual possession for purposes of spoliation relief in Zimbabwean law. It establishes that where an applicant is subject to a court order (such as bail conditions) preventing them from occupying property, they cannot establish the requisite peaceful and undisturbed possession necessary for a spoliation order, regardless of their underlying entitlement to the property. The case also demonstrates that spoliation proceedings are not the appropriate forum for resolving broader property disputes arising from matrimonial breakdown or for addressing anticipated future actions (such as intended lease agreements) that have not yet resulted in dispossession. It emphasizes the evidentiary burden on applicants to specifically demonstrate the nature and extent of alleged interference with possession.
