The State v Sisonke Gwavu

The Accused, Sisonke Gwavu, was convicted on 21 January 2025 of rape on diverse occasions of a nine-year-old girl (his niece), involving sexual intercourse per anum and per vaginam without her consent. The first incident occurred when the Accused was seventeen years old, and the second when he was eighteen. The Accused was the maternal uncle of the complainant and had been caring for his bedridden, sickly mother and the complainant after leaving school in grade 7. On both occasions, an axe was placed next to the bed during the rapes, though it was not used to further traumatize the complainant. The Accused had been in custody for approximately one year at the time of sentencing and had no previous criminal convictions. The complainant suffered significant psychological trauma, including depression, trust issues, fear of male figures, eating disorders, and emotional distress.

The Accused was sentenced to eighteen (18) years imprisonment. The Accused's personal details were ordered to be included in the National Register for Sexual Offenders established under section 42(1) of the Criminal Law Sexual Offences and Related Matters Amendment Act 32 of 2007.

The Court made several non-binding observations: (1) The Court extended the principle from S v Matyityi regarding protection of women's rights to include children; (2) The Court noted that the Accused had not yet attended initiation school according to amaXhosa customs and would still need to attend after serving his sentence at a ripe age; (3) The Court observed that the clinical report (J88) did not provide much assistance in depicting serious injuries, noting that the complainant was examined after a relatively long period following the second rape incident; (4) The Court remarked on the Social Worker's recommendation for direct imprisonment, noting that the Accused could benefit from various Rehabilitation and Victim/Offender Dialogue Programmes offered at Correctional Centres; (5) The Court noted the defence counsel's view that the nurse's observation about a wide hymenal orifice being suggestive of grooming meant there was no vaginal penetration, though the Court found the legal requirement of penetration was met.

This case demonstrates the application of the substantial and compelling circumstances test under Section 51(3) of the Criminal Law Amendment Act 105 of 1997 in cases of child rape.
