The State v Mthabisi Khumalo

On 24 December 2009 at 4th Avenue and Herbert Chitepo Street in Bulawayo, the accused (aged approximately 17-20 years) was at Gijima Nite Club with his friend Butross and two ladies including Cynthia. At around 3:00 am, they left the club. The deceased, Mkhululi Maseko (21 years old), was walking ahead with Cynthia. The accused ran after them and confronted the deceased, claiming Cynthia was his girlfriend. The accused then stabbed the deceased once on the outer aspect of the thigh with an Okapi knife. The knife blade was 10cm long and perforated the femoral artery, causing a 7cm deep wound. The deceased died from hemorrhagic shock resulting from the stabbing. Police on cycle patrol arrived and arrested the accused at the scene. The accused had been carrying the dangerous weapon and was under the influence of alcohol.

Where an accused stabs a victim on the thigh with a knife, even though the weapon is lethal, death is not ordinarily foreseeable in human experience because the thigh is not a vulnerable part of the body. The accused cannot be said to have reasonably foreseen that an artery would be perforated. In such circumstances, the accused causes death negligently and is guilty of culpable homicide rather than murder, notwithstanding the use of a dangerous weapon. The mere use of a lethal weapon does not automatically establish intention to kill; the court must consider whether death was reasonably foreseeable given the location of the injury inflicted.

The court made strong observations about the problem of young people carrying dangerous weapons and resorting to violence at the slightest provocation or without provocation. The court stated that this trend must not be allowed to continue unchecked and that courts must send a loud message that offenders will be adequately dealt with. The court emphasized that imposing lenient sentences such as community service for offenses involving loss of life would trivialize the offense and lead to society losing faith in the criminal justice system. The court also noted its duty to jealously guard the sanctity of human life. The judge remarked that the accused's age estimate may have been inaccurate based on his educational history, suggesting he was likely older (22 years) than the estimated 19 years.

This case illustrates the Zimbabwean courts' approach to distinguishing between murder and culpable homicide based on foreseeability of death. It demonstrates that even when a lethal weapon is used, if the area targeted (the thigh) is not ordinarily a vulnerable part of the body, the accused may not have reasonably foreseen death would result, thereby negating the intention required for murder. The case also demonstrates the court's commitment to imposing substantial custodial sentences for culpable homicide involving weapons, particularly for young offenders, to deter the growing problem of youth violence and weapon-carrying. The judgment emphasizes that community service or lenient sentences would undermine public confidence in the criminal justice system for serious crimes involving loss of life.
