The State v Lovemore Moyo

The accused was charged with possessing gold without a licence or permit in contravention of section 3(1)(a) of the Gold Trade Act [Chapter 21:03]. He pleaded guilty and was convicted. The gold weighed 0.19 grams with a value of $7.69. In mitigation, the accused explained that his wife was pregnant with twins, one fetus positioned outside the womb posing a serious risk to her life. A doctor recommended a surgical operation, but the accused had no money as he was unemployed. He decided to obtain gold to sell to pay for the operation but was arrested before he could sell it and before the operation was performed. The trial court found special circumstances existed and sentenced him to 24 months imprisonment, with 12 months suspended for 4 years on conditions of good behavior and the remaining 12 months suspended on condition of performing community service at Zvishavane Secondary School. The matter came before the High Court on automatic review.

The trial court was directed to forward the record for review after imposing the mandatory sentence. Ndou J agreed with the judgment.

Financial difficulty or personal problems, even of a medical emergency nature, do not constitute 'special circumstances' as contemplated by section 3(3)(a) of the Gold Trade Act [Chapter 21:03] that would justify departure from the mandatory minimum sentence of 5 years imprisonment for unlawful possession of gold. Resorting to criminal activity to solve personal problems or challenges in life cannot be countenanced by the courts as it would create a recipe for anarchy. Where no special circumstances exist, courts are bound to impose the mandatory minimum sentence prescribed by statute and have no discretion to impose a lesser sentence.

The court observed that the accused's conduct was illogical and self-defeating - if he truly believed his wife's medical situation required urgent attention, panning for gold was an ineffective solution as it would take a long time to accumulate sufficient quantities for the operation, thereby exposing his wife to continued danger. The court also noted that the small value of the gold ($7.69) demonstrated the futility of the accused's chosen course of action, describing it as 'a drop in the ocean' relative to the likely cost of a surgical operation. The court suggested that the proper course would have been to borrow money from relatives and friends, which would have enabled him to raise the required amount without resorting to criminal conduct.
