The State v James Ngorima

The accused James Ngorima was married to Lucia Sumaili (the deceased, aged 28) in an unregistered customary law union. They resided together at Ngundu Growth Point in Chivi, Masvingo, along with the deceased's daughter Chantel (aged 6) and her nephew Wayne. The accused was employed by Zimbabwe Amalgamated Housing Association (ZAHA) at Buffalo Range, Chiredzi. The marriage was turbulent and plagued with violence. On the night of 31 March 2018, the couple fought over the accused's alleged infidelity. In anger, the deceased smashed the windows of the accused's motor vehicle and fled to her parents' home about 5 km away. On 1 April 2018, the accused proceeded to his workplace at Buffalo Range where he took/stole a pistol (FN Browning pistol serial number 76C38503) that was being used by security guard Eneas Mungiria. The accused then went to the deceased's parents' home and expressed his intention to divorce. When the deceased's parents left the yard searching for network coverage to call the accused's relatives, the accused retrieved the pistol from his vehicle, entered the house where the deceased and three young children were watching television, and shot the deceased in the forehead, killing her instantly. The accused fled in his vehicle and was arrested at Killer Zivhu's residence 1-2 hours later.

The accused James Ngorima was found guilty of murder with actual intent in contravention of section 47(1)(a) of the Criminal Law (Codification and Reform) Act [Cap 9:23] and sentenced to 30 years imprisonment.

1. In cases relying on circumstantial evidence, the inference of guilt must be consistent with all proved facts and must exclude every other reasonable inference (applying R v Blom 1939 AD 188). 2. Expert medical evidence regarding bullet trajectory and distance indicators (presence or absence of powder burns/skin charring) can scientifically exclude suicide and establish that a gunshot wound was inflicted by another person. 3. An accused person's conduct immediately after an alleged crime (such as fleeing the scene, failing to raise alarm, not reporting to police, and feigning suicide attempt upon arrest) can support an inference of guilt. 4. Under section 257 of the Criminal Procedure and Evidence Act (and consistent with section 50(4)(b)(ii) of the Constitution), where an accused fails to provide explanations to police after being properly warned of the right to silence and its consequences, an adverse inference may be drawn that corroborates other evidence against the accused. 5. Material lies told by an accused regarding critical facts (such as how a murder weapon was obtained) support an inference of guilt. 6. Premeditation can be inferred from conduct such as stealing a firearm, actively searching for the victim, and creating an opportunity to commit the act while feigning peaceful intentions.

The court made strong observations about the prevalence of domestic violence leading to loss of life, noting that many spouses lose their lives at the hands of those expected to love and protect them. Mawadze J expressed concern about the high prevalence of murder cases in Masvingo province, stating this was a reputation the province could do without. The court criticized the investigating officer (D/Sgt. Chimuka) for failing to obtain a statement from the 6-year-old eyewitness Chantel and for not conducting comprehensive forensic testing (fingerprints on the pistol, gunshot residue on deceased's clothing, swabs) to scientifically exclude suicide. The judge noted that despite the accused's purported cooperation, a red flag should have been raised when the accused refused to sign indications or provide a warned and cautioned statement, and that comprehensive investigation is essential in serious cases like murder regardless of any apparent cooperation. The court also criticized the firearm security practices, stating that in the modern era, lethal weapons like firearms cannot be kept casually under beds like shoes, as they may fall into wrong hands with ghastly consequences. This was directed at both ZAHA (the employer) and Span Gold Security Company. The court expressed shock at the accused's lack of contrition and described him as "very hard hearted," noting his callousness in committing the crime at his in-laws' residence showed total disrespect.

This Zimbabwean case demonstrates the proper application of circumstantial evidence principles in murder cases where there is no direct eyewitness testimony.
