The State v Humbulani Ndou

The accused (25 years old) and the complainant (14 years old) were lovers since 2013. During the period from 2013 to 21 February 2015, the accused had sexual intercourse with the complainant on several occasions. The accused impregnated the complainant in 2013 and she delivered in July 2014. The accused then stayed with the complainant at his home. The matter was reported to police by the accused's mother, leading to his arrest. A psychiatrist examined the accused and opined that there was a reasonable possibility that at the time of the alleged crime, the accused was suffering from mental disorder (mild intellectual disability) and was in a state of diminished responsibility, but was fit to stand trial and needed more time for examination. The accused pleaded guilty to contravening section 70 of the Criminal Law (Codification and Reform) Act before the Beitbridge magistrate, who returned a 'special verdict' and released him without punishment.

Diminished responsibility under sections 217-218 of the Criminal Law (Codification and Reform) Act is not a complete defense to a criminal charge but a mitigating factor to be taken into account during sentencing. 2. Mental disorder or defect under sections 226-228 of the Code provides a complete defense only when the requirements of section 227 are met, specifically that the accused was unable to appreciate the wrongfulness of conduct or act in accordance with that appreciation. 3. Medical reports suggesting diminished responsibility must be supported by other evidence and cannot be conclusive on their own; the determination of diminished or absent responsibility is for the court to make. 4. A special verdict of 'not guilty because of insanity' under section 29 of the Mental Health Act is only appropriate where there is complete mental disorder or defect constituting a defense, not merely diminished responsibility. 5. The proper verdict where diminished responsibility is established is 'guilty as pleaded' with the diminished capacity considered as a mitigating factor in sentencing.

The court noted that the psychiatrist's report was not properly sworn as an affidavit and therefore should not have been admitted under section 278(3) of the Criminal Procedure and Evidence Act, though it was nevertheless included in the record. The court also observed that the magistrate displayed 'superficial knowledge' about how to handle such cases, suggesting a need for better training on mental health issues in criminal proceedings. The court commented that a proper inquiry should have been conducted before releasing the accused, especially given the psychiatrist's opinion that 'more time for examination' was required.
