In October 2022, the accused, Hlumelo Yali (aged 21 or 22 at the time), raped a seven-year-old female complainant by inserting his penis into her anus and vagina. The complainant had visited the home where the accused stayed to play with a friend. The accused called the complainant to his room by offering her chips, undressed her, and raped her first on her stomach and then on her back. He failed to stop when she asked him to do so. The rape was painful and caused her to cry. Medical evidence revealed that the complainant's hymen was broken and she experienced minimal dilation and twitching indicative of anal trauma. The examination occurred three days after the incident. A victim impact report showed the complainant exhibited post-traumatic stress, aggressive behaviour, fear of male figures, flashbacks, and trust issues. The accused had no previous convictions, dropped out of school in grade 8, was unmarried, unemployed, and resided with his elder brother and sister. He was diagnosed with cannabis use disorder and had used cannabis and tik extensively since 2016. He had been in custody for over two years, including time spent at Fort England Hospital for psychiatric observation.
