The State v Grace Tsverukai Munyuki

The accused, a Zimbabwean citizen, obtained a forged Malawian passport sometime prior to May 2002 which falsely described her as a Malawian citizen. On 15 September 2003, she approached Egypt Airways to purchase air tickets and was referred to the Malawian Embassy for clearance of the passport before it could be used to buy tickets. When she tendered the passport for clearance at the Malawian Embassy, she was arrested by their passport officer after he discovered that the passport was not authentic. She was charged with contravening Section 36(1)(a)(ii) of the Immigration Act [Chapter 4:02] for using a forged travel document knowing it to be forged. She pleaded guilty in the magistrate's court and was convicted and sentenced to pay a fine of $200,000 or in default ten months imprisonment. The forged passport was surrendered to the Registrar-General. The matter came before the High Court on automatic criminal review.

Furthermore, when an accused pleads guilty to a criminal offence, the presiding magistrate must canvass all essential elements of the offence through clear and exhaustive questions, and obtain clear and exhaustive answers from the accused before entering a conviction. The court must be satisfied that all elements of the offence are established beyond mere inference.

The court observed that the accused could very well have been convicted of other charges as defined in Section 36 or elsewhere in the Immigration Act, but unfortunately nothing in that regard was canvassed. The court also noted that inferences could be drawn from the accused's answer about wanting to join her husband, but emphasized that such inferences are not enough when determining guilt on a plea - the questions and answers must be explicit and comprehensive.
