The State v Aquinata Nyakufa

On 11 September 2009 at village 10, Mayo, the accused, a 40-year-old woman, was attending an all-night prayer session with family members, all belonging to an Apostolic sect, at Rosana Mvere's homestead. The deceased, Ruvarashe Nzirawa, was an 8-day-old infant and the accused's niece. During the night, the accused purported to cure the infant of an unknown ailment. As part of the "curing" process, the accused removed the infant's clothes, applied cooking oil and rubbed salt on the baby's body, and inserted a staff in the infant's mouth. The accused lit a fire, poured more oil on the deceased and the fire, dangled the infant above the flames, and eventually placed the infant in a bucket of water to which she added salt and cooking oil while again inserting the staff in the baby's mouth. The infant was retrieved around 2100 hours at the request of church members and was discovered to have died. A post-mortem examination established that death was due to severe burns. The accused was initially charged with murder but pleaded guilty to culpable homicide, which plea was accepted by the State.

The accused was sentenced to 7 years imprisonment, of which 2 years was suspended for 3 years on condition that the accused does not within that period commit an offence involving the use of violence on the person of another for which she is sentenced to imprisonment without the option of a fine. Effective sentence: 5 years imprisonment.

The court made several non-binding observations: (1) That extremist religious beliefs and practices are "barbaric and have no place in a civilized and progressive society which upholds human rights and the sanctity of human life"; (2) That "there is no room in a progressive civilized community for extremist practices"; (3) That "the religious cult of purporting to have super natural evil and healing spirit under the realm of being possessed by the Holy Spirit has no place in as far as it infringes on other people's rights"; (4) That "religion is there to protect life, the God given right protected by the Zimbabwean Constitution"; (5) The court's observation that the manner of death amounted to "roasting of the deceased in practical terms"; (6) That sentences should "fit the criminal, crime and be fair to society while at the same time being blended with mercy."

This case is significant in Zimbabwean jurisprudence as it addresses the limits of religious freedom when it conflicts with the constitutional right to life. It establishes that extremist religious practices, even when genuinely believed to be healing or helpful, cannot justify conduct that results in death.
