The State v Aaron Tom

On 10 July 2019 at around 23:30 at Chembada Business Centre in Mhangura, Zimbabwe, a brawl at a bar resulted in the death of Lloyd Jonasi. The accused, Aaron Tom, confronted Calvin Boroma seeking a fight. When Boroma moved to another shop to avoid confrontation, the accused followed him. Bright Katandara challenged the accused for bothering Boroma, and the accused attacked Katandara by pulling him from a counter. The deceased, Lloyd Jonasi, intervened to restrain the accused from assaulting Katandara. During the altercation, the deceased was stabbed twice in the chest with a sharp object. The deceased approached Calvin Boroma stating he had been stabbed by the accused and was bleeding profusely. He was rushed to hospital where he died while being attended to by Dr. Goshomi Joseph. The postmortem report indicated the cause of death as cardiac tamponade secondary to hemopericardium and penetrating incision wound into the right ventricle. The accused pleaded not guilty, claiming he did not stab the deceased and suggesting Calvin Boroma, who allegedly had a knife, may have mistakenly stabbed the deceased.

The victim's mind must still be dominated by the event for the statement to be sufficiently spontaneous. When conviction is based on circumstantial evidence, the inference of guilt must be consistent with all proved facts and must exclude every reasonable inference except guilt. Courts should consider the cumulative effect of circumstantial evidence rather than evaluating each item in isolation. Legal intention for murder under section 47(1)(b) can be inferred from circumstances including the use of a lethal weapon causing fatal injuries, the aggressive conduct of the accused, and post-offense conduct indicating consciousness of guilt.
