The State v Aaron Jaricha

On 17 December 2013 at Mufuka Village, Chief Marozva, Bikita, the accused, the deceased Joseph Mudzorwi, and his cousin Josphat Mudzorwi had been drinking beer at Chinhamo Business Centre. Around midnight/2 a.m., they left together and walked home. During the journey, the deceased and accused allegedly exchanged teasing insults about cattle and the deceased's work as a traditional healer's aide. At a junction, the witnesses' accounts diverged: Josphat testified he left the accused and deceased together after the deceased tried to snatch his beer, while the accused claimed he left first, leaving Josphat and the deceased together. Around 2 a.m., the deceased arrived home and told his wife Tracy that the accused had stabbed him on the left side of the chest. He reported the matter to police. The deceased was treated at Silveira Mission Hospital and later died on 5 December 2013. The accused's family paid cattle as compensation. The accused denied stabbing the deceased throughout.

A statement qualifies as res gestae under s 253(2) of the Criminal Procedure and Evidence Act only if made contemporaneously with the act - meaning at the same time or immediately during the event, not some time afterward. A report made after arriving home, even shortly after the incident, does not meet the contemporaneity requirement. 3. For a dying declaration to be admissible, there must be proof that the deceased had a settled hopelessness of death at the time the statement was made. 4. Where the scene of crime is not established, the timeline is unclear, and there is no corroborative evidence, a conviction based solely on circumstantial evidence and inadmissible hearsay cannot stand.

The court observed critically that the investigation was deficient in several respects: the scene of crime was not properly analyzed during daylight despite the investigating officer traversing the same route; it was unclear whether a search was conducted at the accused's home; and there was a general lack of corroborative evidence beyond the testimony of one witness (Josphat). The court noted that the case 'could have benefited from collateral evidence other than Police confining themselves to the one witness.' The court also commented on the questionable practice regarding payment of cattle as compensation by the accused's family, which appeared to influence witness testimony. The court further noted Edmund M. Morgan's criticism of res gestae as a concept that exists due to 'an inclination of judges and lawyers to avoid the toilsome exertion of exact analysis and precise thinking.'
