The accused, aged 13 years at the time of the alleged offence, was charged with the murder of his 3-year-old niece, Catherine Ranga. On 12 December 2009, the accused took Catherine and her siblings to herd cattle. When Catherine accused him of stealing their grandmother's cooking oil, the accused became incensed and assaulted her severely. He used multiple switches (including one with thorns), kicked her repeatedly all over her body, climbed on a rock to deliver kicks to her head, and threw a hard-shelled wild fruit at her head. Catherine fell unconscious, bled from her mouth and nose, and soiled herself. The accused dragged her under a tree and left her there, threatening the other children with death if they reported the incident. Catherine's body was found the next day after her grandmother raised an alarm. The accused was arrested and charged with murder as defined in section 47(1) of the Criminal Law (Codification and Reform) Act. The accused pleaded not guilty to murder but offered to plead guilty to culpable homicide, claiming he only intended to discipline the deceased, not to kill her.

Hungwe J made several important non-binding observations: (1) The court strongly criticized the practice in the Masvingo circuit of relying on external visual examinations of corpses by general medical practitioners rather than proper internal autopsies by qualified pathologists, stating this produces evidence of doubtful value and questioning whether justice is served by convictions based on such inadequate medical evidence; (2) The court called for proper laboratory procedures including toxicology, photography, X-rays and microscopic examination in death investigations, noting that modern information technology should make this achievable; (3) The court condemned the practice of prosecutors delaying cases involving child accused persons until they approach age 14, characterizing this as trampling on children's rights and potentially violating Zimbabwe's obligations under regional and international treaties on children's rights; (4) The court emphasized that the high standard of proof beyond reasonable doubt is not a "charter for criminals" or "mere technicality" but a core component of the fundamental right to a fair trial protected by the Constitution and common law; (5) The court noted that acquittal based on reasonable doubt is "an inevitable consequence of living in a society in which the freedom and dignity of the individual are properly protected and respected," even where suspicions of guilt remain; (6) The court referenced international juvenile justice standards including the Beijing Rules and practices from other jurisdictions (South Africa, Australia) regarding assessment of criminal capacity in children.
