Courts have power and, where necessary, a duty to grant structural interdicts with ongoing supervisory jurisdiction to ensure effective vindication of constitutional environmental rights, particularly where an organ of state has demonstrated persistent non-compliance over extended periods. 8. International environmental agreements ratified by Parliament are binding on municipalities as organs of state pursuant to section 231(4) of the Constitution and must inform interpretation of section 24 pursuant to section 39(1)(b). 9. Operating a landfill site is an inherently polluting activity subject to comprehensive regulatory control because of the potential and actual adverse environmental impacts. The regulatory framework under NEMA, the Waste Act and the National Water Act is designed to prevent such activities from causing environmental harm and protecting public health and well-being. 10. The constitutional right to a healthy environment (section 24(a)) and the state's duty to protect the environment (section 24(b)) are distinct but complementary. While section 24(a) requires proof of harm to well-being, section 24(b) imposes duties on the state regardless of whether actual harm is demonstrated.

ON COMMENDATION OF SAHRC: The court stated the Commission, its investigators and legal representatives "should be commended for taking up and highlighting the issues surrounding the landfill site in the public interest in order to vindicate the constitutional rights of the citizens of Pietermaritzburg." 5.
