Sithabile Tshuma v The State

The appellant was a State certified nurse employed at Antelope Hospital and sent on relief duties to Beula Rural Health Centre. Police, acting on information received, went to her residence at Johunda Township in Gwanda and searched the premises in the appellant's absence (she was at work at Beula Health Centre). The search was conducted in the presence of the appellant's sister. Police recovered various items including curtains, sheets, blankets, syringes, needles, gauze bandages and towels. A stock check at Beula Clinic revealed that property similar to what was recovered was missing from the clinic, including green curtains, yellow curtains, and baby wrappers. The property was found in the appellant's bedroom wrapped in clothing belonging to her. The appellant's housekeeper, Janet Ncube, testified that only she and the appellant had access to the bedroom and she was not aware of the recovered property before the police search. The appellant was charged with theft, alternatively with contravening section 14(1)(b) of the Miscellaneous Offences Act [Chapter 68] (now section 12(2)(b) of Chapter 9:15). She pleaded not guilty to both charges.

The original sentence remained in force: a fine of $400.00 or, in default of payment, two months' imprisonment with labour, plus a further three months' imprisonment with labour suspended for five years on condition that the appellant does not commit any offence of which dishonesty forms an element during that period.

Possession of property for purposes of section 14(1)(b) of the Miscellaneous Offences Act is established when property is found in premises belonging to and under the control of the accused, even if the accused is not physically present at the time of discovery. Where property reasonably suspected to have been stolen is found wrapped in clothing belonging to the accused in a house belonging to and controlled by the accused, this establishes possession beyond doubt. An accused person found in possession of property reasonably suspected to have been stolen must provide a satisfactory explanation for such possession to avoid conviction under the Miscellaneous Offences Act.

The court made an observation that even if the appellant's former employee had been stealing from her house (as the appellant suggested based on previous thefts despite locked premises), it would be implausible that such employee would steal property from the appellant's place of work and place it in her house to trap her. This comment was made to address the credibility of the appellant's defence but was not essential to the ratio decidendi.

This case establishes principles regarding possession of stolen property under the Miscellaneous Offences Act in Zimbabwean law. It clarifies that physical presence at the time of discovery is not required to establish possession where property is found in premises under the accused's control and wrapped in their belongings. The case also demonstrates the evidentiary standard for establishing that property was reasonably suspected to have been stolen and the requirement for an accused to provide a satisfactory explanation for possession of such property. The case illustrates the application of criminal law principles to public sector employees accused of misappropriating government property.
