Siphamandla Matsha v The State

The appellant, Mr Siphamandla Matsha (accused 2), was charged alongside three co-accused with 15 charges including murder, attempted murder, conspiracy to commit murder, and unlawful possession of firearms and ammunition. The state's case was that accused 4 engaged accused 1 (her boyfriend) to hire accused 2 and 3 to kill her mother for payment, as accused 4 stood to benefit from her mother's insurance policies. After a failed attempt in April 2024 that left the mother seriously injured and blind, the group conspired to kill several family members. On 9 October 2024, accused 2 and 3 entered the mother's home and fired multiple shots, killing two family members and seriously wounding two others. A court hearing a bail appeal may only set aside the decision of the court a quo if satisfied that decision was wrong, which requires establishing material misdirection on law or fact. Commonplace personal circumstances (such as being a first-time offender or having a fixed address) do not constitute exceptional circumstances, particularly in serious cases. The state bears no onus to disprove exceptional circumstances in bail proceedings. A holistic assessment of all evidence and circumstances is required when determining whether exceptional circumstances exist.

The court noted that bail proceedings should not become a full-scale dress rehearsal for the trial. While acknowledging that a challenge to admissibility of evidence may in some circumstances result in its rejection by the bail court, not every admissibility challenge should necessarily result in rejection of evidence at the bail stage. The court also observed that less weight may be attached to evidence presented by affidavit compared to oral evidence, though this does not automatically favor the party presenting oral evidence where that party bears the onus of proof.
