Patrice Somueni v The State

The applicant was convicted of robbery in contravention of section 126 of the Criminal Law (Codification and Reform) Act [Chapter 9:23]. He was part of an alleged gang that raided Intrachem Company, a business trading in explosives in Kwekwe, during which robbers physically subdued guards and stole a large consignment of explosives. The applicant was jointly charged with three accomplices. One was discharged at the close of the state case, and two were acquitted at trial. The applicant was convicted and sentenced to 5 years imprisonment with 1 year suspended for 5 years on conditions. He was arrested after police, following a tip-off, apprehended Peter Chapotera who implicated the applicant. Police found the applicant selling some of the stolen explosives and recovered a large quantity concealed underground in a metal drum. The applicant's defense was that he received the explosives from Peter Chapotera to sell on commission to the mining community and concealed them underground as a safety precaution against accidental detonation.

The application for bail pending appeal was granted. The applicant was admitted to bail on the following conditions: (i) deposit ZWL $5000 with the Clerk of Court, Kwekwe; (ii) continue residing at Simindi Village, Chief Njelele, Gokwe until finalization of appeal; (iii) report at Gokwe Police Station on the last Friday of every month between 6:00 am and 6:00 pm until appeal is finalized.

When considering bail pending appeal, the court must primarily consider: (1) the likelihood of the applicant absconding, and (2) the likelihood of the appeal succeeding. These factors must be balanced. The court should lean toward allowing liberty where this can be done without danger to the administration of justice. It is not required that there be a 'reasonable prospect of success' on appeal - a lower threshold applies. Even in serious cases, bail may be granted where the conviction is challengeable on the basis that possession of stolen property is explicable in a manner consistent with innocence, particularly where key witnesses have disappeared and identification evidence is lacking.

The court observed that it is not uncommon for stolen goods to find their way into the hands of unsuspecting members of the public who may be unwittingly hired to dispose of the same for a reward. The court also noted that the seriousness of the offense and the stiffness of the penalty generally increase the incentive to abscond, especially where prospects of success are dim. The court remarked that although the state readily acceded to the application, it nonetheless reserved judgment to properly ventilate the issues, which was particularly important given the inherent seriousness of the offense.

This case illustrates the application of the principles governing bail pending appeal in Zimbabwean criminal law, particularly the balancing exercise between protecting individual liberty and the administration of justice. It demonstrates that even in serious criminal cases, bail may be granted where there are reasonable prospects of success on appeal and the explanation for possession of stolen property is reasonably possibly true. The judgment emphasizes the principle that courts should lean in favor of individual liberty where this can be done without jeopardizing the administration of justice.
