Panashe Alitabu v The State

On 5 September 2023 at Gambuli Farm Settlement, the appellant stole one brown hornless ox and one black cow belonging to Blessing Chamunokora, valued at US$800.00. The appellant appeared before the Chinhoyi Magistrates Court charged with stock theft in contravention of section 114(2)(a)(i) of the Criminal Law Codification and Reform Act. He pleaded guilty to the charge and was convicted and sentenced to 9 years imprisonment. The two beasts were recovered. The appellant then noted an appeal against conviction, alleging procedural irregularities in the plea recording process, including that the court failed to explain essential elements and that he was assaulted by police who were present in court during the plea.

The appeal against conviction was dismissed.

1. Appeals against conviction should be based on the merits (factual and legal findings), while procedural irregularities should be challenged by way of review under section 27 of the High Court Act. 2. Where an accused has pleaded guilty, an appeal against conviction can only succeed in exceptional circumstances where the record shows the accused raised a legitimate defence during the plea proceedings. 3. A magistrate's court record is prima facie a true reflection of proceedings until proven otherwise. 4. An appellant challenging the adequacy of plea proceedings must identify specific questions or responses that were not recorded, rather than making general allegations. 5. Allegations of external pressure on a guilty plea will not succeed where the appellant had opportunity to raise such matters before the trial court but failed to do so, and where the record shows proper compliance with plea inquiry procedures.

The court observed that where an applicant was not legally represented in the court a quo, the appeal court may exercise its review powers to guard against miscarriage of justice. The court noted that the appellant appeared in person and was "obviously not schooled on procedure" but this did not assist him given the clear record showing proper procedure was followed. The court characterized the appellant's grounds as "mischievous" given that he had been specifically asked about complaints against police during the plea proceedings and had said he had none.

This case clarifies the distinction between appeal and review in Zimbabwean criminal procedure, confirming that procedural irregularities should properly be raised by way of review rather than appeal. It reaffirms the principle that appeals against guilty pleas can only succeed in exceptional circumstances where the record discloses a possible defence. The judgment emphasizes the prima facie correctness of magistrates' court records and the need for specific evidence to challenge their accuracy. It also demonstrates that unsubstantiated allegations of external pressure on a guilty plea will not succeed where the court record shows proper compliance with plea recording procedures under section 271(2)(b) of the Criminal Procedure and Evidence Act.
