Organi Mark (Pty) Ltd, a South African company, instituted an action in the Gauteng Division of the High Court, Pretoria in 2020, seeking to declare the respondents personally liable for debts allegedly owed by Spintex Swaziland (Pty) Ltd (Spintex), an eSwatini company that had been liquidated in eSwatini. The respondents were directors of Spintex and resident in Johannesburg within the area of jurisdiction of the high court.
