Norbert Mangena v Minister of Home Affairs and Commissioner General Zimbabwe Republic Police

On 23 March 2014, the plaintiff was in a vehicle (Audi Station Wagon) in Kadoma when police officers shot at the moving vehicle from the roadside. The plaintiff sustained serious bullet wounds and was hospitalized. While in hospital, he was placed under arrest, chained to the hospital bed, and kept under armed guard. He was only informed of the reason for his arrest 12 days later on 4 April 2014 - allegations that he had assaulted police sergeant Eric Salamu and stolen his service pistol. The plaintiff denied the charges in a warned and cautioned statement and was never prosecuted. On 19 September 2014, the police formally acknowledged in writing that the plaintiff had been shot by police as he was a suspect in a robbery case. After giving due notice on 25 September 2014, the plaintiff issued summons on 5 March 2015 claiming damages for unlawful arrest, pain and suffering, medical expenses, loss of amenities and transport expenses, suing on the basis of vicarious liability and constitutional violations.

The special plea of prescription raised by the first and second defendants was dismissed with costs.

The binding legal principles established are: (1) Statutes of limitation do not violate substantive constitutional rights but merely regulate the time within which proceedings must be instituted - they apply to claims based on constitutional violations just as they apply to other claims. (2) A cause of action arises when the creditor/plaintiff becomes aware (or could reasonably have become aware) of both the identity of the debtor and the material facts necessary to sustain the claim. (3) For unlawful arrest claims, while the cause of action generally arises at the time of arrest, in exceptional circumstances involving continuous processes (ongoing detention, threats of prosecution, uncertainty about proceedings), the cause of action may arise at a later date when the plaintiff has full knowledge of the material facts and the continuous process effectively terminates or when it becomes reasonable for the plaintiff to act. (4) Section 70 of the Police Act applies to all civil proceedings against the State or police members for things done or omitted under the Act, regardless of whether the claim sounds in delict or constitutional violation.

The court made several non-binding observations: (1) The plaintiff's brief argument that section 70 of the Police Act is ultra vires the Constitution was described as "half-hearted" and not properly developed. (2) The court noted that the plaintiff's detention while chained to a hospital bed under armed guard constituted a form of detention as he had no freedom of movement. (3) The court observed that not informing the plaintiff of the reasons for his arrest immediately (it took 12 days) was a violation of his constitutional rights. (4) The court characterized the case as a "rare" or "midstream scenario" given the unusual circumstances of arrest during hospitalization, delayed notification of charges, and ongoing threats of prosecution without actual prosecution occurring. (5) The court suggested that restricting the cause of action to 23 March 2014 "would not be proper given the developments outlined above" and the conduct and attitude of the Police.

This case clarifies important principles in Zimbabwean law regarding: (1) the application of statutory limitation periods to constitutional claims - confirming that procedural requirements like limitation periods apply even when claims are based on constitutional rights violations; (2) when a cause of action arises for prescription purposes - particularly that a creditor must have knowledge of both the identity of the debtor and the material facts giving rise to the claim; (3) the distinction between unlawful arrest and malicious prosecution in determining when causes of action accrue; and (4) exceptional circumstances where unlawful arrest claims may arise beyond the date of arrest when there is a continuous process involving ongoing detention threats and potential prosecution. The case provides important guidance on the interaction between the Police Act, prescription laws, and constitutional rights in Zimbabwe.
