Nkani Khoza and Jimmy Moyo and Collet Moyo v The State

On 27 December 2024, three appellants were accused of assaulting two complainants at Wessels Village, Fort Rixon. The complainants were loading cattle into a truck in the company of Mrs Virginia Khoza (wife of the first appellant, Nkani Khoza, aged 65). Nkani arrived and allegedly struck the first complainant (Persistence Chatambarara) with his vehicle, then mobilised the second appellant (Jimmy Moyo, aged 65) and third appellant (Collet Moyo, aged 32) along with other villagers to assault both complainants. The first complainant was allegedly struck with a knobkerrie and kicked multiple times. The second complainant (Hardlife Dube) was allegedly hit with a log, knobkerrie, and stone. Medical reports confirmed injuries sustained. All three appellants pleaded not guilty. Nkani claimed he was defending his property and that the second complainant attacked him first. Jimmy denied involvement. Collet raised an alibi, claiming he was ploughing in the fields at the time. The magistrate convicted all three appellants on two counts of assault and imposed fines and suspended sentences.

a. In respect of the first and second appellants: The appeal against conviction on both counts is dismissed in its entirety. b. In respect of the third appellant: (i) The appeal against conviction on both counts is allowed. (ii) The judgment of the court a quo is set aside and substituted with: The third accused person (Collet Moyo) is found not guilty and is acquitted of both counts of assault. The sentence imposed upon him by the court a quo is set aside.

(1) Where an accused person raises the defence of property, they implicitly admit committing the assault but seek legal justification - this admission satisfies proof of the essential elements of assault. An accused cannot simultaneously deny committing an assault and plead justification for that assault; these are mutually exclusive defences. (2) Where multiple assailants act in common purpose under s 196A of the Criminal Code, each is liable for the assault regardless of whether all physically struck the victim. Mobilising others to commit assault constitutes acting in common purpose. (3) An alibi defence must be investigated by police and prosecution. Where an alibi is raised and remains uninvestigated, and the trial court dismisses it perfunctorily without proper consideration of the evidence, the conviction cannot stand. (4) An appellate court may only interfere with a trial court's credibility findings if they are so outrageous in defiance of logic that no reasonable person properly applying their mind could arrive at the same conclusion. Medical evidence corroborating complainants' testimony supports credibility findings.

The Court observed that it is "no exaggeration to say that the failures of police officers and prosecutors may at times lead to the acquittal of otherwise guilty accused persons." This was stated in the context of the third appellant's acquittal due to failure to investigate his alibi, suggesting the Court may have believed he was guilty but could not uphold the conviction due to procedural failures. The Court also noted that counsel for the appellants argued a ground not pleaded in the written grounds of appeal (the defence of property under ground 3), which is improper procedure. The Court distinguished between attacking factual findings (which was pleaded) versus attacking a failure to apply the law to proven facts (which was not pleaded but argued orally). The Court further observed that an accused who pleads justification "admits having acted or not acted as alleged but denies criminal liability by explaining his apparent criminal conduct as legally excused by the operation of the law" - there was no need for the appellants "to have been coy about it, especially when all of them were navigating the trial with a battery of counsel."

This case clarifies important principles in Zimbabwean criminal law applicable to South African jurisprudence: (1) It reaffirms the high burden on police and prosecution to investigate alibis raised by accused persons, and that failure to do so may result in acquittal even where guilt appears probable. (2) It distinguishes between denying criminal conduct entirely versus admitting conduct while pleading justification - mutually exclusive defences cannot be raised simultaneously. (3) It confirms the doctrine of common purpose in assault cases - where an accused mobilises others to commit assault, they are liable even without personally striking the victim. (4) It reinforces appellate deference to trial court credibility findings unless they defy logic or common sense. (5) It emphasises that defences such as defence of property must be properly pleaded and proved, not raised inconsistently with a denial of the actus reus. The case serves as a reminder of prosecutorial and police duties in criminal procedure.
