Nicole Mpofu v Nhlabathi N.O. and Others

The Applicant filed an application for review on 5 September 2012 under case number HC 3004/12, seeking to set aside a distribution account prepared by the 1st Respondent (the Executor dative of the Estate of late Hedwick Mpofu) dated 31 October 2007 and confirmed by the 7th Respondent (the Additional Assistant Master) on 17 January 2008. The distribution account included cattle, goats, donkeys, household property and an immovable property in Pumula, Bulawayo. The Applicant, who was represented by legal practitioners throughout, sought to review a decision made approximately six years prior without providing reasonable explanation for the delay.

The application for condonation for late filing of review was dismissed.

An application for review must be brought within the time limits prescribed by the applicable rules of court (Order 33 of the High Court Rules requiring review applications to be instituted within 8 weeks). Where there is a delay in bringing a review application beyond the prescribed time limit, an applicant must first seek and obtain condonation for the delay before proceeding with the review. An application for condonation must provide reasonable explanation for the delay. Failure to prosecute an application timeously and without reasonable explanation constitutes an abuse of court process and will result in dismissal of the application. Legal practitioners have a duty to ensure compliance with procedural requirements and to actively prosecute matters they have filed on behalf of their clients.

The court made critical observations about the prevalent practice of legal practitioners filing applications that are never prosecuted, describing this as having become "common place."
