Mehluli Dube and Abel Mpofu v The State

The two appellants were convicted in the Magistrates Court sitting at Masvingo of seven counts of stock theft involving 53 head of cattle. The allegations were that between January and April 2014, in Mwenezi district, the appellants acted in common purpose to steal cattle on seven separate occasions from seven different complainants. The stolen cattle were allegedly transported in hired trucks to Chiredzi where they were sold to Montana meats and Koala meats, and to private individuals. The appellants denied any involvement, claiming they were victims of a conspiracy orchestrated by the first state witness Sifakanye Sibanda (a former police officer and cattle buyer for Montana meats who also ran a transport business). The appellants made formal admissions under section 314 of the CPEA regarding the loss of cattle by complainants and recovery of some beasts from various locations. None of the stolen cattle were recovered from the appellants themselves, but were recovered from Montana meats, Koala meats, Sifakanye, and Benson Chirambamuriwo. The magistrate convicted them and sentenced each to 9 years' imprisonment on each count (totaling 63 years), with 30 years suspended, leaving an effective sentence of 33 years.

The sentence was varied from 63 years' imprisonment (with 30 years suspended, effective 33 years) to 18 years' imprisonment (with sentences in counts 1, 2, 4, and 5 running concurrently, and sentences in counts 3, 6, and 7 running concurrently, with no suspension).

In theft cases, conviction may be sustained even where stolen property is not recovered from the accused, provided the evidence establishes beyond reasonable doubt that the property can be traced back to the accused through the chain of possession. 2. A witness is not automatically a suspect witness requiring application of the cautionary rule merely because they were involved in transactions with stolen property or had some connection to the events; there must be evidence suggesting a reason to falsely incriminate the accused. 3. Evidence must be evaluated holistically, weighing all elements pointing to guilt against those indicating innocence, rather than focusing on isolated pieces of evidence or speculative possibilities. 4. Formal admissions made under section 314 of the CPEA constitute sufficient proof of the facts admitted and relieve the prosecution of the burden to prove those facts. 5. The standard of proof beyond reasonable doubt does not require proof beyond a shadow of doubt or the elimination of every conceivable possibility; fanciful and remote possibilities may be discounted. 6. In sentencing for multiple counts, where offences are closely connected in time and place, the court should consider ordering sentences to run concurrently to avoid disproportionate cumulative punishment. 7. While stock theft is a serious offence warranting substantial custodial sentences, cumulative sentences must not be so severe as to be crushing, and appropriate use of concurrent sentences is necessary to achieve proportionality.

The court observed that not every criminal matter turns on the availability of forensic evidence, and the bulk of criminal cases are resolved in the absence of such evidence. The court also noted that findings of credibility are not exclusively found in explicit statements using those particular words, but may be deduced from a contextual reading of a judgment. The court commented on the seriousness of stock theft as an offence, noting it constitutes a wicked deprivation of the fruits of complainants' hard work and investment, and scuttles efforts at rebuilding the national herd. The court noted that suspended portions of sentences remain integral parts of sentences and should not be disregarded when assessing overall severity, as they carry potential to be activated upon breach of conditions. The judgment also observed that the rationale behind making formal admissions is to reduce the scope of contestation in criminal trials and serves as a tool for curtailment of proceedings.
