Jimmy Zuva v The State

The applicant was arrested on 24 June 2019 whilst in possession of raw ivory valued at $1,828.35 without a permit to deal in ivory. Upon being questioned, he admitted the offence and a warned and cautioned statement was recorded from him, which was later confirmed. The applicant implicated a co-accused during his statement, who was subsequently granted bail by consent as the only evidence against the co-accused was the applicant's implication. The applicant was placed on remand, with the police opposing bail, and was remanded in custody and referred to the High Court for bail consideration. He filed a bail application on 16 July 2019. Investigations were complete and a trial date had been set for 25 July 2019.

The balancing of individual liberty against the interests of justice administration may favour custody where the risk of abscondment is real and the trial is imminent. Each bail application must be determined on its own facts, and the grant of bail to a co-accused based on weaker evidence does not create an entitlement to bail for an accused against whom stronger evidence exists.
