In re Washington Fungisai Mudimbu

Washington Fungisai Mudimbu applied to the Children's Court for guardianship of his minor nephew, Tadiwanashe Blessing Linnel Mudimbu (born 18 August 2004). The minor's father (applicant's brother) passed away on 23 November 2004. The minor's biological mother, Delight Chikohomero, had relocated to Botswana where she married another man and started a new family. The applicant alleged he had become a "de facto guardian" as the minor was left in his custody, and that the child had no natural guardian since the father was deceased and the mother was domiciled in Botswana. The mother filed an affidavit consenting to the guardianship order. The Magistrate's Court granted the application and submitted it to the High Court for review in terms of s 9(6) of the Guardianship of Minors Act [Cap 5:08]. Upon review, the High Court identified serious irregularities including: portions of the mother's affidavit written in ink (not countersigned) with different handwriting, perfunctory proceedings without a meaningful inquiry, and lack of jurisdiction by the Magistrate to grant the order where a biological parent (the mother) was still alive.

The court must be satisfied that the proposed guardian is a "fit and proper person" based on evidence and inquiry, not mere assertion.

The court made several important non-binding observations: (1) Courts of record must maintain proper standards for documentation and should not accept affidavits with unauthorized handwritten additions that are not countersigned, as this raises questions of authenticity and opens the door to potential fraud; (2) The court noted its awareness that courts are "not immune to fraudulent practices" and that "fake documents and or orders have been generated in our jurisdiction," emphasizing the need for vigilance; (3) The court observed it would be "a dereliction of duty" to endorse irregularities, especially where the interests of minor children and rights of biological parents are at stake; (4) The court commented that the applicant's characterization of himself as a "de facto guardian" and his assertion that the minor had no natural guardian were incorrect as a matter of law; (5) The court suggested (without deciding) that the proper forum for such an application (where a natural guardian exists) would likely be a different court with appropriate jurisdiction, possibly the High Court itself.
