The African Christian Democratic Party (ACDP) sought to contest the 1 March 2006 local government elections in the Cape Town Metropolitan Council. Although it timeously lodged its notice of intention to contest, party lists, and ward nominations, it failed to pay the prescribed R3000 deposit to the Electoral Commission’s Cape Town office by the deadline of 19 January 2006. Instead, it made a bulk payment to the Commission’s national office in Pretoria for multiple municipalities, but mistakenly omitted Cape Town from the accompanying list. The omission was conceded to be an error. The Electoral Commission refused to allocate surplus funds from the bulk payment to cover the Cape Town deposit and excluded the ACDP from contesting the election there. The Electoral Court dismissed the ACDP’s challenge, prompting an urgent application for leave to appeal to the Constitutional Court.
