Brian Murambiwa v The State

The appellant was a haulage truck driver who held a normal driver's licence and a defensive driving certificate. On 25 February 2013 around midday, at the intersection of Dieppe Road and Joshua Nkomo Road, Braeside, Harare, a road traffic accident occurred in which seven commuter omnibus passengers died. The appellant was driving a heavy vehicle approaching a robot-controlled intersection when he suddenly changed lanes into the oncoming traffic lane, colliding with three motor vehicles, including two commuter omnibuses. Seven people from one of the omnibuses lost their lives. The appellant claimed he was forced into a sudden emergency situation by a run-away commuter omnibus that crossed his path of travel, but this version was not corroborated by any witnesses including a police detail on traffic duty and a newspaper vendor. The trial court convicted him of culpable homicide and sentenced him to 24 months imprisonment. His driver's licence was cancelled and he was prohibited from driving heavy vehicles for life in terms of s 64 of the Road Traffic Act [Cap 13:11].

The appeal against both conviction and sentence was dismissed in its entirety. The conviction for culpable homicide and sentence of 24 months imprisonment, cancellation of driver's licence, and prohibition from driving heavy vehicles for life were upheld.

An appellate court will not interfere with findings of fact made by a trial court based on the credibility of witnesses, as the trial court enjoys the advantage of seeing and hearing witnesses firsthand and observing their demeanour. The trial court is better placed to assess credibility and its findings will only be overturned where the judgment is demonstrated to be affected by material inconsistencies and inaccuracies, or the court failed to appreciate the weight or bearing of circumstances, or otherwise went completely wrong. In culpable homicide cases arising from road traffic accidents, the sudden emergency defence requires credible corroborative evidence. A driver who suddenly changes lanes into oncoming traffic when it is not safe to do so, fails to stop when an accident is imminent, fails to keep proper control of a heavy vehicle, and fails to keep a proper lookout while approaching a controlled intersection acts negligently and can be convicted of culpable homicide where deaths result.

The court observed that the appellant's failure to stop when he straddled into the opposite lane may also indicate that he was driving at a speed excessive in the circumstances, particularly given that he was approaching a robot-controlled intersection where he was expected to stop if driving conditions required him to do so. The court also noted that drivers of heavy vehicles approaching intersections have heightened responsibilities to maintain proper control and lookout.

This case is significant in Zimbabwean criminal and road traffic law as it: (1) reaffirms the principle that appellate courts will not interfere with trial court findings of fact based on credibility of witnesses unless the trial court can be shown to have gone demonstrably wrong; (2) clarifies the application of the sudden emergency defence in road traffic cases, emphasizing that such defence must be supported by credible evidence; (3) demonstrates the standard of proof required for culpable homicide arising from road traffic accidents involving heavy vehicles; (4) provides guidance on sentencing for culpable homicide cases involving gross negligence and multiple fatalities; and (5) emphasizes the heightened duty of care expected from drivers of heavy vehicles, particularly when approaching controlled intersections.
