Richard John Lawrence, an experienced acting magistrate who had served for several years in the Bloemfontein Cluster and as acting head of the Petrusburg magistrate’s office, applied for permanent magistrate posts in Bloemfontein, Botshabelo and Petrusburg. Despite meeting all statutory and regulatory requirements and having an exemplary performance record, he was not shortlisted for any post. The Appointments Committee of the Magistrates Commission excluded him during shortlisting primarily because he was a white male, relying rigidly on racial and gender considerations under s 174(2) of the Constitution. Lawrence successfully reviewed the shortlisting process in the Free State High Court, which found the process unlawful and unconstitutional. The Magistrates Commission and others appealed to the Supreme Court of Appeal.
