MTN applied to the City of Cape Town for approval to erect a cellular communications base station and mast on a residentially zoned erf in Constantia. Because the zoning did not permit such a structure, MTN obtained a temporary land use departure for five years under the Land Use Planning Ordinance. MTN then submitted building plans under the National Building Regulations and Building Standards Act. After objections from neighbouring property owners, the City initially refused the plans under section 7 of the Act, but later approved the same plans under Regulation A23 by classifying the base station as a ‘temporary building’ for five years. The neighbouring landowner, the Stemar Trust, sought judicial review of the City’s decision, arguing that the base station was not temporary in nature. The High Court set aside the approval, and MTN appealed to the Supreme Court of Appeal.
