The applicant, Mbashe Diocese of the Anglican Church, administered the Lower Gwadu Parish, which conducted church services on a property in the Lower Gwadu Administrative Area. The property included a church building and accommodation for reverends. A dispute arose in December 2022 when the first respondent was not ordained as a reverend by the Bishop. Congregants boycotted services, leading to tension between the Diocese and certain community members. At a community meeting on 2 March 2023 at the homestead of the fifth respondent (the traditional leader), the caretaker reverend, Reverend Sifuba, was compelled under threats and intimidation to hand over the keys to the property to the fifth respondent. Since then, the Diocese and its congregants were denied access to the property. The applicant sought a mandament van spolie, ancillary interdictory relief, and a declarator asserting lawful possession and occupation of the property.
