The appellant was arrested on 19 March 2025 and charged with numerous counts of fraud and theft allegedly committed between Cape Town and East London. Although the charge sheet referred to over 100 counts, only 51 offences were reflected, of which four were allegedly committed in the Eastern Cape and only two within the jurisdiction of the Mdantsane Magistrate’s Court. The appellant applied for bail in the Mdantsane Magistrate’s Court, supported by a detailed affidavit addressing the statutory bail factors under section 60(4) of the Criminal Procedure Act. He averred that he had a fixed address, family and business ties, no prior convictions, no pending cases, and was not a flight risk. The magistrate refused bail without engaging with or analysing the contents of the appellant’s affidavit. The appellant appealed the refusal of bail to the High Court under section 65 of the Criminal Procedure Act.
