The appellant (Gardner) had obtained an order from the High Court granting him personal rights to take transfer of certain immovable property from the first respondent (Dampier Development) upon payment of the purchase price in terms of an agreement of sale. The order was conditional upon payment within three days, but the appellant failed to make payment. During this period, the fourth respondent (Export Credit Guarantee Corporation) purchased the same property, paid for it, and had it registered in its name. The fourth respondent was a bona fide purchaser without notice of the appellant's personal rights. The appellant then sought a declaration in the court a quo that the first respondent had lost dominium in the property by virtue of it having become res litigiosa at the closure of pleadings on 24 March 2006. The court a quo dismissed this application, and the appellant appealed to the Supreme Court.
