The appellant, a Bulgarian national, was convicted in Bulgaria of murder and sentenced to 18 years’ imprisonment. While on warning pending a final appeal, he travelled to South Africa in December 2014 on a visitor’s visa which later expired. Following a request by Bulgarian authorities, he was arrested in South Africa in August 2018 and became the subject of extradition proceedings under the Extradition Act 67 of 1962. During the extradition enquiry he was granted bail, which was progressively relaxed, and he complied with all conditions over several years. In November 2024 the magistrate found him liable to be extradited under section 10(1) of the Act and committed him to prison pending the Minister’s decision. He noted an appeal under section 13(1) and applied for bail under section 13(3), which the magistrate refused on the basis that he was a flight risk and lacked prospects of success on appeal. The appellant appealed to the High Court against the refusal of bail.
