Lieutenant General Betty Ngobeni was appointed as the Provincial Commissioner of Police for KwaZulu-Natal in 2009, with her appointment renewed in 2014. In March 2016, the Acting National Commissioner of Police, Lieutenant General Phahlane, established a board of inquiry into allegations of misconduct, unfitness for office and/or incapacity against her, and notified her of an intended suspension. After considering her submissions, he suspended her with effect from May 2016. Ngobeni approached the KwaZulu-Natal High Court to review and set aside both the establishment of the board of inquiry and her suspension, arguing that the National Commissioner lacked the legal authority to act without first involving the Provincial Executive Council. The High Court upheld her application. The National Commissioner and the Minister of Police appealed to the Supreme Court of Appeal.
