In October 2009, four respondents participated in a robbery at a shop in Table View, Cape Town. The third and fourth respondents entered the shop and robbed the owner while threatening her with a knife. The first respondent (Ms Masingili) acted as a scout, inspecting the shop beforehand and waiting outside in a parked car. The second respondent (Mr Volo) waited in the car and drove the respondents away after the robbery. All four were convicted of robbery with aggravating circumstances in the Regional Magistrate's Court. On appeal to the Western Cape High Court, the court questioned the convictions of Ms Masingili and Mr Volo as accomplices, finding they had no proven intent regarding the use of the knife. The High Court declared section 1(1)(b) of the Criminal Procedure Act unconstitutional insofar as it created strict liability by including the phrase "or an accomplice".
