The applicant was employed by the respondent municipality in June 2009 as a General Worker Grade 19 in the Community Services department. In November 2012 he applied for a transfer to the Public Safety department. He alleged that in December 2012 he was promoted or transferred to the position of Law Enforcement Officer Grade 12, that he performed the duties of that position, wore the official uniform, and was deployed accordingly. The municipality denied that any promotion ever took place and disputed that the required statutory and policy procedures for promotion were followed. In earlier proceedings, an order by consent reinstated the applicant as a General Worker, directed payment of an acting allowance, and required an enquiry into the validity of the alleged promotion. In this application, the applicant sought declaratory relief that he was a Law Enforcement Officer Grade 12 and that his placement as a General Worker was unlawful.
