The applicant, Mount Frere Builders and Furniture Suppliers (Pty) Ltd, sought restoration of possession of assets seized on 2 August 2024 by the sheriff acting on instructions from the respondents. The seizure was effected pursuant to a prior court order obtained by Kot Plus (Pty) Ltd authorising attachment of goods from various premises, including those described as “Mt Frere Builders”. The applicant alleged that the seizure was unlawful because the order did not correctly cite its full registered corporate name and therefore did not authorise attachment of its assets. The respondents contended that the applicant was clearly identifiable as the entity trading as “Mt Frere Builders”, that goods had been sold and delivered to it, and that the sheriff acted lawfully under a valid court order.
