SGR Finance (Pty) Ltd instituted an opposed application for summary judgment against Centurion Med Inc and its director, Ms Engela Magdalena van Wyngaardt, for payment of R111 952.50 plus interest and costs. The claim arose from a Master Rental Agreement concluded on 22 May 2024, in terms of which SGR Finance rented telecommunications and office equipment to Centurion Med Inc, with Ms van Wyngaardt binding herself as surety and co‑principal debtor. The plaintiff alleged that the first defendant defaulted on monthly rental payments, resulting in arrears and accelerated future rentals. The defendants entered an appearance to defend and resisted summary judgment, raising several points in limine and substantive defences, including lack of authority, lack of locus standi, non‑liquidated claim, non‑compliance with procedural rules, applicability of the National Credit Act and Consumer Protection Act, defective equipment, invalid cancellation, and unjust enrichment.
