The plaintiff instituted action against the Minister of Police arising from his arrest and detention by members of the South African Police Service on 6 September 2022 in Mthatha. He alleged that he was arrested without a warrant in public, detained at Central Police Station under inhumane conditions, and held for nine days until his release on bail on 15 September 2022. The criminal charge was subsequently withdrawn when video footage showed he was not the perpetrator. The plaintiff claimed damages of R900 000 for unlawful arrest, detention and related court appearances. The defendant’s defence was struck out, and the plaintiff applied for default judgment.
