The appellant, Siphamandla Matsha, appealed against the refusal of bail by the Motherwell District Magistrate’s Court on 19 December 2024. He was charged, together with three co-accused, with 15 serious offences including murder, attempted murder, conspiracy to commit murder, and unlawful possession of firearms and ammunition. The State alleged that the appellant was hired, together with another accused, to carry out contract killings orchestrated by a family member who stood to benefit from insurance policies. After an initial failed attempt that left the intended victim blind, a second attack on 9 October 2024 resulted in two deaths and two serious injuries. The State relied on affidavits by the investigating officer, confessions by co-accused, section 204 statements, and anticipated corroborative evidence such as cell phone and banking records. The appellant contended that the State’s case was weak as it relied on inadmissible confessions by co-accused and that his personal circumstances and alibi constituted exceptional circumstances justifying bail.
