The applicant, Ms Adele Horn, concluded a written building contract with the respondent, Ovofield (Pty) Ltd, in February 2022 for the construction of a residential dwelling on her immovable property in Gqeberha. The contract price was R1 186 847.00 and was to be completed within eight months of NHBRC registration. The respondent drew approximately 84% of the contract sum from the applicant’s Nedbank building loan facility. Due to dissatisfaction with workmanship and delays, snag lists and expert reports were commissioned. The respondent asserted a builder’s lien over the property for alleged unpaid expenses amounting to R47 774.25 and retained possession of the keys. The applicant cancelled the contract in May 2024, denied liability for the amount but tendered the same as security to substitute the lien, seeking restoration of possession. The respondent refused, contending it retained a valid lien and that the security was inadequate. The applicant approached the High Court for substitution of the lien by security and delivery of possession.
